Terms and Conditions
 
These Terms and Conditions govern your use of, and access to, the Chronus mentoring portal (“the Portal”) and any content you contribute (“Content”) as both a mentor and mentee.

Monash Acceptable Use Policy

In using the Portal you agree to:
  • Use the Portal for lawful purposes only.
  • Provide accurate information.
  • Be aware of Monash University’s values and to commit to preserve and support these values.
  • Maintain boundaries appropriate to the mentoring program to ensure the safety of participants.
  • Understand the aims and limitation of your mentoring program.
  • Agree to a code of conduct specific to the mentoring program that you are participating in.
  • Maintain the confidentiality of all information shared within the mentoring partnership.
  • Advise Monash mentoring staff immediately if a problem arises in the mentoring relationship.
  • Advise Monash mentoring staff immediately if any conflict of interest or potential conflict of interest arises.
  • Comply with Monash’s policies and procedures in relation to its information technology resources (including the Information Technology Acceptable Use Policy and Information Technology Acceptable Use Procedure) and Monash’s Behaviours in the Workplace Procedure and Integrity and Respect Policy (as applicable).  Copies of these policies and procedures are available here.

In addition, if you are a student of Monash University, you agree to adhere to the Monash University Student Charter.

The above conditions are in addition to the Acceptable Use Policy of Chronus available at https://chronus.com/aup.

Additional Requirements for Mentors

In addition to the conditions outlined above, if you use the Portal as a mentor you also agree to:
  • Complete any training assigned to you by your program level administrator.
  • Comply with the Child Safe Standards Framework and the Code of Conduct.
  • Complete an Australian Working with Children Check prior to being matched with a mentee.
  • Notify Monash immediately of any changes to the status or validity of your Working with Children Check.
General Terms and Conditions

Use and Copyright
The Portal and its content are subject to copyright under the laws of Australia and other countries.  Unless otherwise indicated, copyright in content on the Portal is owned by Monash University.  In addition, third parties may own the copyright in some materials incorporated within the Portal and, in such cases, written permission may be required from these parties to use such material.

Other than as permitted under the Copyright Act 1968 (Cth), no material on this Portal may be reproduced without the prior written permission of Monash University, except that you may save an electronic copy or print out parts of this Portal solely for your own information, research or study, provided that:
  • You do not modify the copy as it appears on the Portal.
  • You include the University’s copyright notice and/or acknowledge the relevant third party source.
In relation to Content you contribute to the Portal, you represent and warrant that you own or have the necessary licenses, rights, consents and permissions to publish your Content.  You retain all rights in your Content.  By submitting your Content through the Portal you grant Monash University a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display and perform your Content in connection with the Portal.

You agree that you will not attempt to hack into the Portal or use any robot, spider or other device or process to use the Portal for any unauthorised purposes.  You agree that you will not take any action that imposes an unreasonably large burden on the Portal.

Personal Security Information
You are responsible for maintaining the confidentiality of your account information and for restricting access to your computer and you agree to accept responsibility for all activities that occur under your control, including unauthorised access to your account or password.

Confidentiality
Although all mentors and mentees who access this Portal agree to maintain the confidentiality of all information shared within the mentoring partnership, as the mentors and mentees may not be affiliated with Monash University, the University cannot guarantee that any information you disclose to your mentor or mentee (as applicable) will be kept confidential by the recipient.

Disclaimer and limitation of liability
While Monash University attempts to ensure that the information on the Portal is accurate at the time of publication, it provides no express or implied warranties and does not make any representations in relation to this Portal or any content.  In particular, Monash University does not guarantee and is not liable for the advice given to you in your capacity as a mentee by any mentor.  This information on this Portal is provided ‘as is’ and without any guarantees as to its accuracy, currency, completeness or reliability.  Monash University reserves the right to amend the information on this Portal at any time and without notice, including but not limited to information relating to courses, units, admissions, fees and services.

Monash University is not liable for any loss or damage occasioned by your use of this Portal or information contained on this Portal.  You agree that your use of this Portal is at your sole risk. 

To the extent permitted by law Monash University will not be liable for any direct, incidental, consequential or indirect damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your access to, or use of, or inability to use the Portal and its content, whether based in contract, tort, negligence, statute or any other cause of action, and whether or not Monash University is aware of the possibility of such damage.  If a jurisdiction does not allow the exclusion or limitation of liability in accordance with this paragraph, but allows a limitation of a certain maximum extent, then the liability of Monash University is limited to that extent.

Applicable Law
These terms and conditions must be construed in accordance with, and governed by, the laws of the State of Victoria.  You agree to submit to the jurisdiction of the courts in the State of Victoria.

Withdrawing access to Portal
Monash University may, in its sole discretion, withdraw, suspend or refuse to permit you to participate in any mentoring program on the Portal for any reason without notice.  In particular, this discretion may be exercised where, in Monash’s opinion, any of the following has occurred:
  • You have breached any of these Terms and Conditions, or any applicable law or regulation in relation to your use of the Portal.
  • You have provided misleading, deceptive or incorrect information.
  • A complaint has been received about you.
  • Your participation in the mentoring programs on the Portal is likely to, or does, damage or is detrimental to Monash’s reputation or brand.
Modifications to these terms and conditions
Monash University may modify these terms and conditions at any time and will publish such modified terms and conditions on the Portal.  By continuing to access the Portal after such modifications have been published you are agreeing to be bound by such modified terms.

Chronus Terms of Service
Acceptable Use Policy
This Acceptable Use Policy (“AUP”) applies to your use of the Chronus Services (“Services”) and any content you contribute (“Content”). You agree you will not use the Services for any purpose that is unlawful or prohibited by this AUP. You may not use the Services in any manner that could damage, disable, overburden, or impair the Services, networks connected to the Services or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks through any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
User Conduct. The Services allow you to submit Content. You agree to only submit Content that is proper. By way of example, and not as a limitation, you agree that when submitting Content, you will not:
  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information.
  • Submit Content in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
  • Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consent to do the same.
  • Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another.
  • Download any file posted by another user of the Services that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner.
  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such Submission Tool specifically allows such messages.
  • Violate any applicable laws or regulations.
  • Create a false identity for the purpose of misleading others.
Chronus has no obligation to monitor your Content. However, we reserve the right to review materials posted and to remove any materials in our sole discretion.
Chronus reserves the right to terminate your access to any or all of the Services at any time, without notice, for any reason whatsoever.
Chronus reserves the right at all times to disclose any information as we deem necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in our sole discretion.
Use caution when giving out any personally identifiable information. Chronus does not control or endorse the content, messages or information submitted in the Services and, therefore, Chronus specifically disclaims any liability with regard to any submissions in the Services and any actions resulting from your submission of Content and participation in any areas where content may be submitted in the Services.
Use of Content. Your Content will be able to be viewed by other users of the Services. You should only provide your Content if you are comfortable sharing it with others.
You understand that Chronus does not guarantee the confidentiality of your Content and you shall be solely responsible for your Content and the consequences of submitting and publishing your Content on the Services. You represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish your Content.
You retain all right in your Content. By submitting your Content through the Services you hereby grant Chronus a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your Content in connection with the Services.
Feedback. Any suggestions, comments, or other input you give to Chronus (“Feedback”), even if designated as confidential, will not create any confidentiality obligation for Chronus. Chronus will be free to use, reproduce, license or otherwise distribute, and exploit Feedback to improve and enhance Chronus products, technology, services, documentation or otherwise. Chronus’ use of Feedback does not create any obligation to you. You agree not to provide Chronus with any Feedback that is subject to license terms that seek to require any Chronus products, technologies, services or documentation incorporating or derived from such Feedback, or any of Chronus intellectual property, to be licensed or otherwise shared with any third party.
Courses Terms. These Courses Terms apply to your use of the Chronus Courses ("Courses") program. Please review these terms. We may suspend your access to the Chronus Services and/or the Courses at any time if we believe you are not complying with these terms.
Courses Requirements. You must act responsibility as described in the AUP. In addition to the AUP terms, you agree that:
  • You may participate in the Courses and/or receive a digital certificate only if you act in compliance with these Courses terms.
  • Participation in the Courses and therefore accessing any online content and courses by anyone under the age of 13 is strictly prohibited.
  • You are not eligible to participate in the Courses program if you are a resident of the regions that are prohibited by export controls and sanctions programs.
  • You must take the relevant Courses through Chronus and/or if the Course offers a certificate, you might potentially be required to receive a passing score to obtain a valid Certificate. Each Certificate's validity term may differ.
  • You will participate in the Courses program in a professional manner and will not allow any other individual to access your Chronus account or benefits. If the relevant Course requires you to pass an exam for Certificate, you will not receive any unauthorized assistance to pass the exam.
  • The Courses may be offered by Chronus, or your employer or by other third parties. Chronus does not review or endorse the content or Courses of your employer or any third parties. Any Certificate may only be used to represent that you are acknowledged by Chronus or the applicable party for participating and completing courses in the Courses program and/or for passing an exam to obtain the Certificate.
  • Chronus may discontinue the Courses program at any time in its sole discretion.
  • Chronus will use your personal information that you provided for the participation of the Courses program in accordance with the Privacy Notice.
NO WARRANTIES. CHRONUS MAKES NO WARRANTY THAT THE COURSES PROGRAM, ANY MATERIALS, INFORMATION, SOFTWARE, OR CONTENT (A) WILL MEET YOUR EXPECTATION (B) WILL BE TIMELY, SECURE, UNINTERRUPTED, FREE OF ERRORS OR VIRUSES. CHRONUS MAY PROVIDE YOU THE ABILITY TO ACCESS AND/OR USE CONTENT PROVIDED BY OTHER THIRD PARTIES OR BY SERVICES MAINTAINED BY THIRD PARTIES. WE HAVE NO OBLIGATION TO MONITOR THIRD PARTY CONTENT, BUT RESERVE THE RIGHT TO REVIEW AND/OR REMOVE ANY POSTED CONTENT. CHRONUS DISCLAIMS ANY AND ALL LIABILITY RELATED TO YOUR ACCESS OR USE OF THE COURSES PROGRAM OR ANY RELATED CONTENT. YOU ACKNOWLEDGE AND AGREE THAT ANY ACCESS TO OR USE OF THE COURSES PROGRAM OR SUCH CONTENT IS AT YOUR OWN RISK.
